1. Purpose and acceptance
This Legal Notice governs access to, browsing of and use of the website www.shelldiamonds.com (hereinafter, “the Website”), without prejudice to the Owner’s right to establish specific conditions for particular services or content. Access to and browsing of the site confers the status of user and implies full and unreserved acceptance of the conditions set out in this Legal Notice, in the Privacy Policy and in the Cookies Policy. Users who do not agree with their content must refrain from using the Website.
The purpose of the Website is the distance selling of jewellery made with laboratory-grown diamonds. The conditions applicable to the purchase of products are set out in the General Terms and Conditions of Sale, in the Shipping Policy, in the Returns, Withdrawal and Refunds Policy and in the Warranty Policy, which constitute separate documents complementary to this Legal Notice.
The user undertakes to use the Website in accordance with the law, good faith, public order and this Legal Notice, and to refrain from using it for unlawful purposes or purposes harmful to the rights and interests of third parties, as well as from carrying out any action that may damage, disable, overload or impair the Website or prevent its normal use.
In particular, the following is prohibited:
- Using the Website in a manner contrary to applicable local, national or international regulations, or for an unlawful or fraudulent purpose or with unlawful or fraudulent effect.
- Using automated systems, robots or programs of any kind to systematically extract, copy or reuse the contents of the Website, in particular the images, descriptions and prices of the products.
- Introducing or disseminating viruses, Trojans or other computer code intended to alter the operation of the Website or of the equipment or networks from which it is provided.
- Accessing without authorisation any part of the Website, the equipment or networks on which it is hosted or the software used to provide it.

Links to the home page of the Website are permitted provided that they are established fairly and lawfully, without damaging or taking advantage of the Owner’s reputation, and without suggesting non-existent association, approval or sponsorship. Reproduction of the Website within frames of other pages is not permitted. The Owner may revoke this authorisation at any time.
2. User-generated content
Where the Website enables functionalities allowing users to publish content, such as reviews, comments or photographs of the products, the user warrants that they hold the necessary rights over such content and that it is not defamatory, obscene, offensive or discriminatory, does not infringe third-party rights, is not misleading as to its authorship and does not breach confidentiality obligations.
The user authorises the Owner to reproduce and publicly communicate such content on the Website and through its communication channels, for the purpose of showcasing the shopping experience. The Owner may withdraw any content that does not comply with the foregoing.
The reviews published correspond to persons who have actually purchased the product. The Owner verifies this circumstance by linking each review to a confirmed order.
3. Intellectual and industrial property
All the contents of the site (including, by way of example and without limitation, texts, product photographs, graphic designs, images, trade marks, logos, source code, structure and selection of contents) are owned by GENESIS LAB, S.L. or by third parties who have authorised their use, and are protected by national and international intellectual and industrial property legislation.
Access to the Website does not confer on the user any right over such contents. Their reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, is expressly prohibited without the prior written authorisation of the Owner.
4. Liability and links
The Owner does not guarantee the availability and uninterrupted continuity of the operation of the Website, although it will exercise due diligence to maintain its operability and, where applicable, to restore it as promptly as possible. The Owner shall not be liable for damage arising from the unavailability of the Website for reasons beyond its control, including incidents affecting the hosting provider or the communication networks.
The provisions of this clause are without prejudice to the liability incumbent on the Owner as seller vis-à-vis consumers and users under consumer protection legislation, which is in no case limited or excluded by this Legal Notice.
GENESIS LAB, S.L. shall not be liable for damage arising from misuse of the site. The Website may contain links to third-party sites. The Owner exercises no control over such sites and is not liable for their contents, privacy policies or commercial practices. The existence of a link does not imply any recommendation of, or connection with, those responsible for them.
5. Protection of personal data
The processing of personal data provided through the Website is governed by the provisions of the Privacy Policy and the Cookies Policy, which are permanently accessible from all pages of the Website.
6. Amendment of this Legal Notice
The Owner reserves the right to amend this Legal Notice in order to adapt it to legislative or case-law developments or to changes in the Website itself. Amendments shall take effect upon publication.
7. Applicable law and jurisdiction
This Legal Notice is governed by Spanish law.
For the resolution of any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals having jurisdiction under the law. Where the user is a consumer, the court corresponding to their domicile shall have jurisdiction, no agreement to the contrary being possible, and the user shall retain the protection afforded by the mandatory provisions of the law of their country of habitual residence.
