Warranty Policy
This Policy governs the legal guarantee of conformity applicable to products purchased at shelldiamonds.com by consumers and users, in accordance with Articles 114 et seq. of the Spanish General Law for the Defence of Consumers and Users (TRLGDCU).
The party liable to you for compliance with this guarantee is GENESIS LAB, S.L., in its capacity as seller, irrespective of the fact that products are manufactured and dispatched by third parties. You should not address any claim to the manufacturer or to any other party in the supply chain.
Sales to businesses or professionals are governed by the warranty regime provided for in the Civil Code and the Commercial Code and by their specific conditions.
1. Duration of the guarantee
We are liable for any lack of conformity that becomes apparent within three (3) years of delivery of the product. Unless proven otherwise, any lack of conformity that becomes apparent within the first two (2) years of delivery is presumed to have existed at the time of delivery, without you having to prove it. The right to claim lapses five (5) years after the lack of conformity becomes apparent.
2. What counts as a lack of conformity
The product must correspond to the description, type, quantity and quality offered, and possess the characteristics you may reasonably expect. The following, among other situations, will be considered a lack of conformity:
- The item does not correspond to the description, dimensions, weight, metal fineness or characteristics of the stone indicated on the product page or in the gemological certificate.
- Manufacturing defects in the setting, the clasp, the soldering or the finish.
- The stone coming loose or being lost for reasons not attributable to you.
- Delivery of an item other than the one ordered, or of an incomplete product.
3. Your rights
In the event of a lack of conformity, you are entitled to have the product brought into conformity free of charge by repair or replacement. The choice between repair and replacement rests with you, unless the option chosen proves impossible or entails disproportionate costs for us. Bringing the product into conformity will be carried out within a reasonable time and without significant inconvenience to you.
You will be entitled to a proportionate reduction in price or to termination of the contract where: bringing the product into conformity proves impossible or disproportionate; we have not done so within a reasonable time; the lack of conformity persists despite an attempt to remedy it; or the lack of conformity is so serious as to justify it. Termination will not be available where the lack of conformity is minor, the burden of proof lying with us.
4. Free of charge
Bringing the product into conformity is free of charge for you, covering the costs necessary to remedy the lack of conformity — in particular transport, shipping, collection, labour and materials. You will not have to pay any amount for the return of the non-conforming item.
5. What is not covered
The legal guarantee does not cover damage or deterioration that does not constitute a lack of conformity, and in particular:
- Normal wear and tear resulting from use of the item, including surface micro-marks on the metal.
- Damage caused by knocks, drops, crushing, or contact with chemical products, cosmetics, chlorine or salt water.
- Alterations, repairs, resizing or handling carried out by third parties unconnected with us.
- Loss or misplacement of the item after its delivery.
6. Gemological certificate
Items are delivered with a gemological certificate issued by an independent laboratory (IGI), attesting to the characteristics of the stone, including its status as a laboratory-grown diamond. The certificate refers to the stone and does not certify the metal of the setting or the finished item as a whole.
7. How to claim
Notify the lack of conformity to info@shelldiamonds.com, stating your order number, describing the defect and attaching, as far as possible, photographs of the item. We will acknowledge receipt and indicate the procedure for collection or dispatch of the item, the costs of which we bear in full.
8. Impossibility of supply
Where we are unable to replace the item due to unavailability, we will inform you without delay. You may then choose between waiting for the product to be restocked, accepting an expressly notified period, or terminating the contract — in which case we will refund all amounts paid within a maximum of fourteen (14) calendar days.
9. Relationship with other rights
The rights recognised in this Policy are independent of, and compatible with, the right of withdrawal described in our Returns, Withdrawal & Refunds Policy, and are without prejudice to any actions available to you regarding liability for defective products.
